www.zephyrgroup.ro Web Site and the services provided therein are only available to users seeking employment ("Candidates") or companies seeking employees ("Employers") and are subject to the Terms and Conditions below. If you do not accept the Terms and Conditions, please do not use www.zephyrgroup.ro. Zephyr HR & Consulting ("the ZEPHYR GROUP") may revise the Terms and Conditions from time to time - once inserted in the website, it is deemed noticed.
Candidates agree that they will only use the ZEPHYR GROUP's web site (and any other sites accessed through them) for lawful purposes and to seek employment.
The ZEPHYR GROUP also reserves the right to edit any candidate's resume as it sees fit. Candidates acknowledge and agree to the ZEPHYR GROUP's practice of charging Employers a fee for access to the candidate's resumes and details. The candidates also recognize that she/he has no claims to any such fees received by the ZEPHYR GROUP. Candidates accept that personal data given to Employers or other users are given entirely at their own risk.
Employers/companies will be entitled to use the ZEPHYR GROUP's web site to advertise jobs vacant for a predetermined period following agreement of the predetermined service. The ZEPHYR GROUP reserves the right to edit any advertisement or web page as it sees fit. The ZEPHYR GROUP reserves the right to change the fee or institute new charges or fees, as it deems appropriate. In the event that any Employer should fail to pay the fee or any other fees or charges due to the ZEPHYR GROUP, the ZEPHYR GROUP reserves the right to suspend or terminate the Employer's advertisement, without prior notice to the Employer and further, without prejudice to all other rights and remedies.
Candidates agree not to use any of the ZEPHYR GROUP's site for any of the following purposes which are expressly prohibited:
- Candidates shall not post any non-resume information and/or incomplete, false or inaccurate resume information which is not their own accurate resume.
- All users are prohibited from violating or attempting to violate the security of the ZEPHYR GROUP's site including, without limitation, accessing data not intended for them or logging into a server which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil or criminal liability.
- All users will not use the ZEPHYR GROUP's web site in order to transmit, distribute or store material in violation of any applicable law or regulation, or in any manner that will infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or that is libelous, obscene, threatening, abusive or hateful.
The graphics, images, editorial content and HTML on all the ZEPHYR GROUP's site are the intellectual property of the ZEPHYR GROUP and may not be downloaded or otherwise duplicated without the express written permission of the ZEPHYR GROUP. Re-use of any of the foregoing is strictly prohibited and the ZEPHYR GROUP reserves all rights.
The ZEPHYR GROUP may not monitor the site at all times but reserves the right to do so. The ZEPHYR GROUP takes no responsibility whatsoever for any material inputted by any user or others and not posted by the ZEPHYR GROUP. All users acknowledge and agree that they are solely responsible for the form, content and accuracy of any resume, advertisement, or material contained therein placed by them. The ZEPHYR GROUP is not responsible for the content of any other web sites linked to the ZEPHYR GROUP's web sites; links are provided as Internet navigation tools only. The ZEPHYR GROUP does not warrant that any resume, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. The ZEPHYR GROUP is not in anyway to be considered to be an agent with respect to any users use of the ZEPHYR GROUP's web sites and the ZEPHYR GROUP will not be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on the ZEPHYR GROUP's web sites.
The ZEPHYR GROUP does not warrant that its web site will operate error-free or that its web site and its server are free of viruses or other harmful mechanisms. If use of the web sites or their contents result in the need for servicing or replacing equipment or data, by any user, the ZEPHYR GROUP will not be responsible for those costs. The ZEPHYR GROUP 's web site and its content is provided on an "as is" basis without any warranties of any kind. To the fullest extent permitted by law, the ZEPHYR GROUP disclaims all warranties, including without prejudice to the foregoing, any in respect of merchantability, non-infringement of third party rights, fitness for particular purpose, or about the accuracy, reliability completeness or timeliness of the contents, services, software, text, graphics and links of the ZEPHYR GROUP’s web site.

THE ZEPHYR GROUP, ITS EMPLOYEES OR AGENTS SHALL NOT BE LIABLE IN ANY EVENT FOR ANY LOSSES OR DAMAGES SUFFERED BY ANY USER WHATSOEVER ARISING OR RESULTING FROM THEIR USE OR INABILITY TO USE THE ZEPHYR GROUP'S WEB SITE AND ITS CONTENTS.
Without prejudice to the above, the aggregate liability by the ZEPHYR GROUP to any user for all claims arising from their use of the ZEPHYR GROUP's services and the ZEPHYR GROUP's web sites shall be limited to the amount of the existing package fee subscribed to and paid for by the user (if any) and operative at that time.
This Agreement and any dispute or matter arising from or incidental to the use of the ZEPHYR GROUP's web site shall be governed by the laws of Romania. |
